1. About Reclaim and these Terms

Reclaim Medical, Inc. (“Reclaim,” “we,” “us”) provides billing-reclamation software used by healthcare providers (“Providers”) to communicate with their patients about billing and to connect them with payment options. These Terms govern your use of this website and the SMS messaging program. If you received a message, it was sent on behalf of your Provider using our platform. By using this site or the messaging program, you agree to these Terms.

2. The SMS messaging program

  • These are transactional account/billing notifications on your Provider’s behalf — not marketing. They help you, for example, forward an insurance reimbursement that was sent to you directly, or connect with payment options.
  • You enrolled by providing your mobile number to your Provider and agreeing to receive billing notifications through your Provider’s intake/consent process.
  • Message frequency varies. Message and data rates may apply. Reply STOP to stop messages (one confirmation follows, then no further texts); reply HELP for help, or call your Provider at the number shown. Wireless carriers are not liable for delayed or undelivered messages.

3. Not professional advice

Messages and this site provide account/billing information only and are not medical, legal, tax, or financial advice. For care questions, contact your Provider.

4. Payments

We do not process payments on this site. To resolve or pay your balance, contact your Provider using the phone number shown in your message or on the payment page; the payment page connects you with your Provider. If online payment becomes available in the future, it will be governed by additional terms presented at that time.

5. Acceptable use

Do not misuse the site — no unlawful use, interference, unauthorized access, or attempts to disrupt the service.

6. Intellectual property

The site and software are owned by Reclaim or its licensors and are provided for your personal use in connection with your Provider’s communications.

7. Disclaimers

The site and messaging program are provided “as is” and “as available,” without warranties of any kind to the maximum extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Reclaim will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the site or the messaging program.

9. Indemnification

You agree to indemnify Reclaim against claims arising from your misuse of the site or violation of these Terms, to the extent permitted by law.

10. Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules; venue lies in the state and federal courts located in New York.

11. Changes

We may update these Terms; continued use after the posted effective date constitutes acceptance.
